How Is Inflation Impacting Medical Malpractice Claims? Find Out in Our New Study
The Doctors Company, part of TDC Group, is committed to commissioning independent, third-party research that examines the most pressing challenges in healthcare and the medical malpractice industry. Our new study, Nuclear Verdicts and Rising Costs: How Inflation Is Impacting Medical Malpractice Claims, indicates that inflation—both economic and social—has added an estimated $4 billion in insured losses and expenses to the medical malpractice insurance market over the past decade.
This was a significant increase from the $2.4 to $3.5 billion that was found in our 2023 research report that addressed the impact of social inflation on medical malpractice claims for the decade ending in 2021. The latest research confirms that inflation is not only persistent—it’s accelerating. The study, conducted by Moore Actuarial Consulting, LLC, on behalf of The Doctors Company, incorporates updated data from the National Practitioner Data Bank and insurance company annual statements through year-end 2024.
At a time when medical malpractice verdicts are at an all-time high, this study outlines key reasons why it is critical for your clients to protect themselves and their practice with appropriate coverage from TDC Group.
Advice for How Your Clients Can Counter Medical Misinformation and Support Engaged Patients
Between December 2024 and January 2025, we surveyed and gathered 368 physicians’ answers to 11 questions about their profession, keeping our survey’s time window brief to capture an accurate snapshot of our respondents’ sentiments toward their calling in that moment.
The survey findings reflect clinicians’ efforts to navigate their increasingly complex environment—one in which professional autonomy and fulfillment are being compromised. Among the findings was that Americans typically seek out health information by contacting their doctor and the internet equally. Of those who secure health information from the internet, 86 percent are confident the information is credible.
This can sometimes be a challenge for healthcare practitioners, because health misinformation—information that is false, inaccurate, or misleading according to the best available evidence at the time—is abundant on the internet. Health misinformation is a significant obstacle in healthcare, as it can lead to misunderstandings, poor health decisions, and adverse outcomes for patients.
In a recent article published by The Doctors Company, we address many of the challenges of health misinformation and make suggestions for how your clients can combat the problem.
Has a Client of Yours Received Notice of a Claim? Share These Key Tips for Coping With Litigation
Few things in a healthcare practitioner’s life generate more stress and disruption than an allegation of professional malpractice.
The litigation process and the uncertainty it creates may cause a practitioner to experience stress-related symptoms—including anger, anxiety, depression, or physical illness. The first step in alleviating the uncertainty is to understand the litigation process and your role as a defendant.
If your clients are ever the subject of a claim (a patient’s verbal or written demand for compensation) or formal lawsuit, The Doctors Company will fiercely and uncompromisingly defend their livelihood and reputation, and we will be with them throughout the process.
We encourage you to share these tips for coping with litigation with clients of yours if they have received notice of a malpractice claim.
Nearly 50 Years of Relentless Advocacy for Medical Liability Reform and Patient Access to Care
In today’s shifting healthcare environment, doctors, medical practices, advanced practice clinicians, and health systems need an active advocate—a resolute voice loud enough to be heard. TDC Group has relentlessly supported medical liability reform and worked to safeguard patient access to healthcare for nearly five decades.
We lead the industry with a dedicated, award-winning Government Relations team and the only medical liability advocacy program covering all 50 states and the federal level. We defend reforms that are in place, prevent legislation from being enacted that would undermine the defenses of our members, and take opportunities to enact new measures that would limit liability exposure for our members and healthcare professionals across the country.
We dedicate ourselves to this calling so that those caring for our communities can make decisions based on the best outcomes for patients, rather than the ever-present threat of litigation, invasive regulation, or financial loss.
The video below explains more about our unrivaled advocacy efforts.
