Napa, California—September 3, 2015—The Doctors Company, the nation’s largest physician-owned medical malpractice insurer, recently convened over 300 of the country’s premier legal defense attorneys and malpractice industry experts at its 2015 National Legal Summit.
The summit, which is central to The Doctors Company’s mission to provide the industry’s most aggressive claims defense for its members by keeping top defense teams up to date on new developments, was held July 24 and 25 in Napa.
“The Doctors Company is relentless in protecting and defending our members,” said David McHale, senior vice president and general counsel, The Doctors Company. “At this summit, defense attorneys who represent our members heard from experts on emerging national and local topics, litigation strategies, and best practices. Our goal was to provide them with the superior advantage that comes from a comprehensive understanding of the issues surrounding medical malpractice litigation.”
Among the top issues identified was how the Affordable Care Act (ACA) could potentially reduce damages in medical malpractice claims. A panel of four malpractice defense attorneys discussed the impact of healthcare reform on medical professional liability claims and new litigation tactics. Panelists noted that judges and juries might be convinced to reduce damages for future care awarded in medical malpractices cases because plaintiffs, who in the past had no healthcare insurance, now have these medical costs covered by the ACA.
Richard E. Anderson, MD, FACP, chairman and CEO of The Doctors Company, started the summit with an update on the malpractice insurance market during a time of unprecedented healthcare change. Guest speakers included Alison Levine, bestselling author of “On the Edge: The Art of High Impact Leadership” and an adventurer who has climbed the highest peak on each continent and skied to both the North and South Poles.
