Southern California Physician Advisory Board Update

The semiannual meeting of The Doctors Company Southern California Physician Advisory Board convened recently in Los Angeles. The group consisted of physicians across many specialties, representatives from The Doctors Company, and local defense attorneys.

David Troxel, MD, medical director of The Doctors Company, started the meeting with an excellent presentation on the pitfalls and legal implications of electronic health records (EHRs). Discussion included issues with templates and drop-down menus and EHR discovery during the course of litigation.

An important aspect of the meeting was the presentation of litigated cases and important lessons that can be learned from them. A robust discussion ensued with input from physicians, claims and patient safety professionals, and attorneys involved in the cases.

The first case emphasized the importance of clear communication among different providers to properly relate the urgency of a situation and ensure there is a sign-out process prior to transferring the care of a patient.

The last case presented highlighted that unexpected events arise even in relatively low-risk procedures, and careful monitoring should occur postoperatively as indicated.

The meeting concluded following a presentation by Richard F. Cahill, an attorney with The Doctors Company, who discussed HIPAA, the HITECH Act, and the MediGuard® and CyberGuard® coverage provided by The Doctors Company.

These meetings are opportunities for physician leaders to learn more about the workings of The Doctors Company and to share their views with the company.
